Portland Cement Case Goes Haywire Despite Evidences And Strong Testimonials


Dr. Rajan Lekhraj Mahtani is a noted businessman in Zambia with more than three decades of successful business experience. He has established numerous companies which are not only known for their ethical and transparent business practices but also for their focus towards unprivileged sections of the society. Some of these companies are Finance Bank Zambia, Mahtani Group of Companies and Finsbury Investments. At present, Dr. Mahtani is contesting for the legal takeover of one of his own companies, Portland Cement Zambia. The factory was illegally taken over from him ten years ago and soon after that, a case was registered at the Lusaka High Court of Zambia. However, the other parties launched a counter claim and it has been ten years of the trial proceedings without any concrete judgment, until now.

During the trial period, Dr. Mahtani submitted some of the strongest evidences to justify his claim. Some of these documents were signed shareholder’s agreement, financial exhibits, independent auditor’s report and financial exhibits. On the other hand, the other parties were unable to provide any strong evidence to support their claims. Also, the judge made a positive announcement few months back when it was announced that the case hearing is closed. This meant the court will not keep any more hearings and trials. Both parties were asked to submit their evidences, documents and testimonials in written and oral format and based on these evidences, the judge was supposed to announce the final judgment.
However, the final judgment was a shocker as it was announced against Dr. Mahtani’s claims. Dr. Mahtani then took the right steps and has appealed to the higher court of Zambia against this judgment.
