Plan By Ventriglias Against Portland Cement Does Not Go Well, Supreme Court Rejects Case

In a bizarre incident, the Ventriglias decided to challenge the decision made by the higher Court of Appeal on the Portland Cement Zambia case. The case of Portland Cement Zambia is age old and was first registered at the Lusaka High Court by Dr. Rajan Mahtani himself. A significant political meddling and unethical corporate practices took over and Dr. Rajan Mahtani was not given justice despite having all evidences and testimonials to show for it. The judgement by Lusaka High Court judge Nkonde went in favour of the Ventriglias and Dr. Rajan Mahtani took the right decision to approach the higher Court of Appeal. The judge at the higher Court of Appeal was justice Mwinde who gave the final decision on the case on 31st January 2019. In this decision, the previous judgement from the Lusaka High Court was reversed as the majority ownership of the Portland Cement Zambia went to Dr. Rajan Mahtani only. This decision from the higher Court of Appeal was considered final until the Ventriglias decided to engage in political and corporate meddling once again.

After more than 20 months of the decision from the Court of Appeal, the Ventriglias challenged this decision at the Supreme Court Zambia. To evaluate this challenge, a bench of three judges was established at the Supreme Court Zambia. The bench evaluated the appeal and found that the appeal did not qualify the legal obligations which require appeals against previous court decisions to be made within 14 days of the judgement itself. Furthermore, it was also found that the Ventriglias did not have the required evidences to support their claim. As such, their claim was rejected and Dr. Rajan Mahtani remains the owner of Portland Cement Zambia factory.
