Lusaka High Court’s Decision On Portland Cement Zambia Flawed, Claims Dr. Mahtani
Laws are rules,
regulations and conditions which provide standards for living for a
city, state or nation. Government bodies such as courts are
established for ensuring safety and security of the common citizens
by providing truthful and transparent justice for everyone. However,
when this system fails to deliver, it is the common citizens who
suffer the most. Take the example of Portland Cement Zambia factory.
The factory was established by Dr. Rajan Mahtani and during its glory
days, the cement-manufacturing factory was producing in surplus,
making it one of the biggest producers of cement within the nation.
At the same time, it was also a popular employer within the
manufacturing sector with above-industry average wages and salaries.
As such, the factory was also a major source of economy as well as
livelihood for the local workers.
However, the
current condition of the factory is undeniably difficult, with
factory production lower than standards and most of the workers
facing difficulties due to issues in wages and payment as well as
lack of leadership. For the past ten years, case is being dragged
within the court because of reasons such as lack of evidences, lack
of commitment from the parties as well as frequent transfer of
judges. On the other hand, the major losers or sufferers in this
situation are the people working for the factory. Life has become
difficult for them again.
The final
judgment on the factory was recently announced in which judgment was
given against Dr. Rajan Mahtani. Notwithstanding this judgment, Dr.
Mahtani has taken immediate steps and has made an appeal to the
higher court of Zambia.
