Starts At Lusaka High Court, Closes At Higher Court Of Appeal, Peculiar Case Of Portland Cement



The peculiar case of the Zambezi Portland Cement is exactly what the government of any nation must avoid. This case and its long pendency along with complications highlights the rampant corruption and unethical practices which has penetrated even the legal system of Zambia. Dr. Rajan Lekhraj Mahtani is a noted businessman, philanthropist as well as charity worker. His unique trait or characteristics while working within the Zambian nation is his track record. Dr. Rajan Mahtani is among the most honest, transparent and ethical businessmen in Zambia and with this transparency and honesty, he has established numerous successful businesses in Zambia. He fought for the Zambezi Portland Cement case for more than ten years and after several roadblocks and challenges, finally won the case. 

This decision on the Portland Cement Zambia case was given on 31st January 2019 by higher Court of Appeal. It was a significant decision as it was completely against the decision given by Lusaka High Court judge around a year back which confirmed Ventriglias as the only shareholders of the Portland Cement Zambia. Contrary to this decision which was given against all evidences and testimonials, justice Mwinde on behalf of the higher Court of Appeal declared Dr. Mahtani as the actual owner of the Portland Cement Zambia factory. This decision was given based on the evidence that Dr. Mahtani had already paid a sum of one billion kwachas, equivalent to USD 250,000 to the Zambezi Portland Cement in exchange for the entire value of the share capital of the Zambezi Portland Cement factory. Based on this evidence and many other facts and testimonials, Dr. Rajan Mahtani was identified as majority shareholder and legal owner of the Portland Cement Zambia factory.
