Final Verdict On Portland Cement Case Misdirected By Lusaka High Court, Correct Decision From Court Of Appeal


Even though Dr. Rajan Mahtani finally received justice at the end, this was after years of patient wait, perseverance and undeniable faith in the legal system of Zambia. Dr. Rajan Mahtani has established itself as one of the most successful businessmen in Zambia. He has deep roots within the Zambian economy and society and almost all of his business and entrepreneurial contributions are aimed at improving the economic and social conditions of the Zambian society. Despite these critical contributions, it is really problematic to observe that Dr. Rajan Lekhraj Mahtani is constantly fighting for his right. The political, ethical and legal challenges faced in the developing nation like Zambia is understandable. However, there are only few businesses who keep the grit and confidence of maintaining an ethical, honest and transparent business venture.



After Dr. Rajan Mahtani faced misfortune at the Lusaka High Court, he turned to higher Court of Appeal for help. At this situation, most businessmen would retreat or would possibly resort to unethical practices. However, Dr. Rajan Mahtani did neither of these and approached the higher Court of Appeal for justice. The judge at the higher Court of Appeal was justice Mwinde who gave the final decision on 31st January 2019 after looking into all evidences and testimonials. It was found that Dr. Rajan Mahtani made a payment of one billion kwachas, equivalent to USD 250,000 to the Portland Cement Zambia limited in the year 2007. This payment was made with the objective of gaining 58 percent shares of the Portland Cement Zambia factory.

Based on these evidences, Dr. Rajan Mahtani was finally given the ownership of Portland Cement and the misjudgement from Lusaka High Court was corrected.
